Use of the website’s functionalities implies acceptance of these GCU.

The user therefore undertakes to read these GCU carefully when accessing the site, and is invited to download, print and retain a copy.

It is specified that the present GTU are available in the footer of the site by means of a hypertext link and can be consulted at any time.

4. Technical specifications

By using the website, the User acknowledges that he/she has the necessary means and skills to use the functionalities offered on the site.

The equipment required to access and use the site is at the User’s expense, as are any telecommunications charges incurred by their use.

6. Obligations of the parties

6.1 User Obligations

When using the website, each User undertakes not to undermine public order and to comply with the laws and regulations in force, to respect the rights of third parties and the provisions of these GCU.

Each User is obliged to :

  • Behave in a fair and reasonable manner towards the Site Editor and third parties ;
  • Be honest and sincere in the information provided to the Site Editor and, where applicable, to other Users;
  • To use the site in accordance with its purpose as described in these GCU ;
  • Not divert the purpose of the site to commit crimes, offenses or contraventions punishable by the Penal Code or by any other legal or regulatory provision ;
  • Respect the privacy of third parties and the confidentiality of exchanges ;
  • To respect the intellectual property rights of the author of the site concerning the elements of the site and, where applicable, the intellectual property rights of other Users;
  • Not to seek to undermine the automated data processing systems implemented on the site, in particular through practices such as web-scraping, in accordance with Articles 323-1 et seq. of the French Penal Code;
  • Not to modify the information put online by the Site Editor or by another User ;
  • Not to use the site to send unsolicited bulk messages (advertising or otherwise) ;

In compliance with the legal and regulatory provisions in force and in accordance with the law of July 29, 1881 relating to freedom of the press, the User undertakes not to disseminate any message or information :

  • Constitute wrongful denigration of the Site Editor or Users of the Site ;
  • Contrary to public order and morality ;
  • of an abusive, defamatory, racist, xenophobic or revisionist nature, or which is prejudicial to the honor or reputation of others;
  • Inciting discrimination or hatred of a person or group of people because of their origin or their membership or non-membership of a particular ethnic group, nation, race or religion ;
  • Threatening a person or group of people ;
  • Of a paedophile nature ;
  • Inciting to commit an offence, a crime or an act of terrorism, or glorifying war crimes or crimes against humanity ;
  • Inciting suicide ;
  • Directly or indirectly enabling third parties to obtain pirated software, software serial numbers, software enabling acts of piracy and intrusion into computer and telecommunications systems, viruses and other logic bombs, and in general any software or other tool enabling infringement of the rights of others and the security of persons and property;
  • Of a commercial nature (canvassing, soliciting, prostitution, etc.).

6.2 Obligations of the Publisher

The Site Publisher’s general obligation is an obligation of means. The Publisher is under no obligation of result or reinforced means of any kind.

The Publisher undertakes to do its utmost to ensure continuity of access and use of the site 7 days a week, 24 hours a day.

However, the Publisher wishes to draw Users’ attention to the fact that current Internet communication protocols do not allow the transmission of electronic exchanges (messages, documents, identity of sender or recipient) to be guaranteed with certainty and continuity.

Furthermore, in accordance with the provisions of articles L 111-7 et seq. of the French Consumer Code, the Publisher undertakes to provide clear, transparent and fair information on the terms and conditions of its services.

7. General principles

The Site Editor declines all responsibility in particular:

  • In the event of temporary inability to access the site for technical maintenance or updating of published information. Users acknowledge that the Site Editor cannot be held liable in the event of malfunctions or interruptions in said transmission networks ;
  • In the event of viral attacks or unlawful intrusion into an automated data processing system ;
  • In the event of abnormal use or illicit exploitation of the site by a User or a third party ;

In the event of abnormal use or illicit exploitation of the site, the User shall be solely liable for any damage caused to third parties and for the consequences of any claims or actions arising therefrom.

8. Act of god

The Site Publisher shall not be held liable if the non-performance or delay in performance of any of its obligations described in these GCU is due to an Act of God.

Act of God in contractual matters occurs when an event beyond the debtor’s control, which could not reasonably have been foreseen at the time the GCU were concluded and whose effects cannot be avoided by appropriate measures, prevents the debtor from fulfilling its obligation.

If the impediment is temporary, performance of the obligation is suspended unless the resulting delay justifies termination of the GCU. If the impediment is definitive, the GCU shall be cancelled ipso jure and the Parties shall be released from their obligations under the conditions set out in articles 1351 and 1351-1 of the French Civil Code.

In the event of an Act of God, the Site Editor will endeavor to inform the User as soon as possible.

12.4 Data retention and processing policy of the basilique du Sacré Cœur de Montmartre

Who receives your personal data ?

Access to personal data is limited to the services of the Basilica of the Sacred Heart of Montmartre and its subcontractors with whom it has a contractual relationship in order to achieve the purpose of the processing. Personal data will not be disclosed to third parties, except in the following cases :

  • When you have given your prior consent for sharing and/or disclosure ;
  • When required by law or in order to protect its rights and interests.

The Basilique du Sacré Cœur de Montmartre does not pass on your personal data to third-party advertisers for marketing purposes.

The length of time personal data is kept varies according to the purpose for which it is processed.

In the case of donations, data may be collected for the purpose of sending tax receipts and other requests for donations for projects related to the life of the Basilica or its restoration. Data is kept for a minimum of 6 years from the date of your last donation, in accordance with the requirements of the French tax authorities (http://bofip.impots.gouv.fr/bofip/8877-PGP.html).

12.5 Security and storage of your data

The Basilica of the Sacred Heart of Montmartre is particularly concerned about the personal data we collect and process. These operations are carried out in a secure manner. We implement the necessary technical, physical and organizational measures to prevent, as far as possible, any alteration, loss or unauthorized access to your personal data.

Personal data is stored in the European Union in the databases or files of the Basilica of the Sacred Heart of Montmartre or in those of service providers with whom the Basilica of the Sacred Heart of Montmartre has a contractual relationship.

If any of the stipulations of the present GCU should be declared null and void with regard to a legislative or regulatory provision in force and/or a court decision having the force of res judicata, it will be deemed unwritten but will in no way affect the validity of the other clauses, which will remain fully applicable.

Any such modification or ruling shall in no way authorize Users to disregard these GCU.

13. Modification of the GCU

These GCU apply to all Users browsing the site.

The GCU may be modified and updated by the Publisher at any time, in particular to adapt to changes in legislation or regulations.

14. General provisions

The fact that one of the Parties has not required the application of any clause of these GCU, whether permanently or temporarily, shall in no case be considered as a waiver of said clause.

In the event of difficulty of interpretation between any of the headings appearing at the top of the clauses and any of the clauses, the headings will be declared non-existent.

15. Jurisdiction and applicable law

These GCU and the relationship between the User and the Site Editor are governed by French law.

In the event of a dispute arising between the Site Editor and a User concerning the interpretation, performance or termination of these GCU, the Parties shall endeavor to settle the dispute amicably.

In such a case, the User is first invited to contact the Site Publisher’s user service department.

In the event that mediation fails or is not envisaged, the dispute which may have given rise to mediation will be referred to the competent court, in application of the territorial jurisdiction rules in force and applicable to the present contract.
